SUMMARY OF RULES OF PROCEDURE

 

AGENDA: The Chairperson may reschedule items on the agenda.† Order of the agenda will be: non-contested matters, contested matters, then staff presentations.

CONDUCT OF HEARINGS: The sequence for a contested matter is: (1) staff report and environmental document discussion; (2) testimony of proponent(s); (3) public testimony; (4) rebuttal by applicant; (5) close of public hearing; (6) Commission discussion and vote.

LIMITED TIME FOR DISCUSSION: A principal proponent will be allowed a 5-minute statement.† Other proponents and opponents are allowed 3-minute statements except that a spokesperson for any group may be allowed 5 minutes.† The principal proponent shall have a 3-minute rebuttal.

VOTING: Any action or recommendation of the Commission requires a majority (3 votes) of the Commission to concur therein.† Any motion for approval or disapproval of a matter which results in a tie vote shall be forwarded to the Board of Supervisors with no recommendation.

ADDRESSING THE COMMISSION: Any person addressing the Commission shall, when recognized by the Chairperson, step to the rostrum and give their name and address.† Statements which lack factual support and repeated or cumulative testimony should be avoided.† Groups of people with similar viewpoints are urged to appoint a spokesperson to represent their views.

EXHIBITS OR DOCUMENTS: Documentary evidence submitted to the Commission becomes the property of the Commission.

CONTINUANCES: The Commission may continue any matter at its discretion.

 

Matters under the jurisdiction of the Commission and not on the posted agenda, may be addressed by the general public following completion of the regular agenda and any off agenda matters before the Commission for consideration.† The Commission limits testimony on matters not on the agenda to three minutes per person and not more than fifteen minutes for a particular subject.

The Cosumnes Community Planning Advisory Council (CPAC) met on September 26, 2012 and recommended APPROVAL (6-0) of the proposed project.

 

ENVIRONMENTAL DOC.:

REQUEST:

To revert properties back to prior zoning and lot configuration in effect prior to the approvals dated May 13, 2009, associated with a project know as Matsuoka (Control No. 06-GPB-RZB-SVB-AHS-0141/ZMA 5593).† Note: Only a portion of the project site (204 acres of the total 387 acres) was subject to a General Plan Amendment and Rezone approval in May 2009.† The Matsuoka rescission includes the following new requests:

 

A General Plan Amendment for approximately 204 acres from Agricultural-Residential to General Agricultural (20 acres).

 

Rezone of approximately 204 acres from AR-2 (Agricultural Residential) to AG-80 (Agricultural).

 

A Tentative Subdivision Map to divide the 387-acre project site into four (4) lots as currently reflected on the Assessorís Parcel Map, shown as APNs 126-0050-083, 126-0050-084, 126-0050-085 and 126-0050-086.

The Southeast Community Planning Advisory Council (CPAC) met on October 4, 2010 and recommended APPROVAL (7-0) of the initial project request.

 

ENVIRONMENTAL DOC.:

Exempt

 

REQUEST:

A Use Permit to legalize an existing outdoor recreational facility (Airsoft pellets) in an open field on a portion of an 18.5-acre parcel in the AG-20 (Permanent Agricultural) and AG-20(F) (Flood combining) zones.† Note that corn mazes and pumpkin patches are permitted activities where agricultural uses are practiced.

 

A Special Development Permit to deviate from the following Zoning Code provisions: a) To allow the internal access aisles to be gravel in lieu of a dust free surface. b) To allow the parking lot to be gravel instead of a dust free surface. c) To allow zero landscaping adjacent to East Stockton Boulevard in lieu of providing a landscaped planter 18 feet in width. d) To allow reduced landscaping internal to the parking lot in lieu of a minimum shading requirement of 40 percent.
