SUMMARY OF RULES OF PROCEDURE

 

AGENDA:  The Chairperson may reschedule items on the agenda. Order of the agenda will be: scheduled public hearings then opportunity for the public to address the Commission.

CONDUCT OF HEARINGS:  The sequence for a hearing matter is (1) staff report and environmental document discussion; (2) testimony of the applicant(s); (3) public testimony; (4) rebuttal by applicant; (5) close of public hearing; (6) Commission discussion and vote.

LIMITED TIME FOR DISCUSSION:  Public testimony will be limited to 3 minutes per speaker.  The Chairperson may grant 5 minutes to a spokesperson of a recognized group.  Applicant testimony and rebuttal may be limited by the Chairperson.

VOTING:  Any action or recommendation of the Commission requires a majority (4 votes) of the Commission to concur therein.  Any motion for approval or disapproval of a matter which results in a tie vote shall constitute denial if final action is by the Commission.  If final action is by the Board of Supervisors, a tie vote shall be forwarded to the Board of Supervisors with no recommendation.  A vote to abstain is not to be construed as a vote for or against a motion.

ADDRESSING THE COMMISSION:  Any person addressing the Commission shall, when recognized by the Chairperson, step to the podium and give their name and address.  Statements which lack factual support and repeated or cumulative testimony should be avoided.  Groups of people with similar viewpoints are urged to appoint a spokesperson to represent their views.

EXHIBITS OR DOCUMENTS:  Documentary evidence submitted to the Commission becomes the property of the Commission.

CONTINUANCES:  The Commission may continue any matter at its discretion.

 

Matters under the jurisdiction of the Commission and not on the posted agenda may be addressed by the general public following completion of the regular agenda.  The Commission limits testimony on matters not on the agenda to three minutes per person and not more than fifteen minutes for a particular subject.

Negative Declaration

 

REQUEST:

A Use Permit to allow a primary service station rebuild and associated approximately 2,400 square foot AM PM facility on approximately 0.46 gross acres in the LC (Limited Commercial) zone.

 

A Deviation from the design clearance height for the pump island canopy.

 

A Variance to deviate from the following Sacramento County Zoning Code (SZC) Standards: 

A reduction in the public street frontage requirement of approximately 135 feet for automobile service stations, per SZC Section 340-31.  The proposed project will have a public street frontage of approximately 130 feet along Hazel Avenue. 

A reduction in the landscaping lot coverage requirement of 20% for automobile service stations, per SZC Section 340-36.  The proposed project will have a landscaping lot coverage estimated at 15%.

 

A Special Review of Parking to allow a reduction in the required number of parking spaces from eleven (11) to eight (8) spaces, per Sacramento County Zoning Code (SZC) Section 330-20.

 

A Design Review to comply with the Commercial and Mixed Use Community Design Guidelines.

Recommend approval of the Use Permit, subject to the findings and conditions outlined in Addendum No. 1, as further amended by the Commission. Recommend approval of the Deviation from the Canopy Height, subject to the findings and conditions outlined in Addendum No. 1, as further amended by the Commission. Recommend approval of the Special Review of Parking, subject to the findings and conditions outlined in Addendum No. 1, as further amended by the Commission. Recommend approval of the Design Review. Recommend approval of the Variance, subject to the findings and conditions outlined in Addendum No. 1, as further amended by the Commission.

Accepted the Negative Declaration as adequate and complete. REQUEST:

A Zoning Code Amendment to revise the definition of funeral establishments and conditionally allow such uses with crematories in GC (Commercial Zones) and M-1 and M-2 (Industrial) zones.

PLANNING/NEIGHBORHOOD SERVICES REPORT

 

8:55 PM  Board Action: Keri Blaskowski reported on the resident parking permit stickers that have been distributed and the signs that were installed on Banister Road. Enforcement will start on May 18, 2009 after a two week grace period. She also reported that the directional signage has been installed at Fair Oaks Village.
