SUMMARY OF RULES OF PROCEDURE

 

AGENDA:  The Chairperson may reschedule items on the agenda. Order of the agenda will be: scheduled public hearings then opportunity for the public to address the Council.

CONDUCT OF HEARINGS:  The sequence for a hearing matter is (1) staff report and environmental document discussion; (2) testimony of the applicant(s); (3) public testimony; (4) rebuttal by applicant; (5) close of public hearing; (6) Council discussion and vote.

LIMITED TIME FOR DISCUSSION:  Public testimony will be limited to 3 minutes per speaker.  The Chairperson may grant 5 minutes to a spokesperson of a recognized group.  Applicant testimony and rebuttal may be limited by the Chairperson.

VOTING:  Any action or recommendation of the Council requires a majority (4 votes) of the Council to concur therein.  Any motion for approval or disapproval of a matter which results in a tie vote shall constitute denial if final action is by the Council.  If final action is by the Board of Supervisors, a tie vote shall be forwarded to the Board of Supervisors with no recommendation.  A vote to abstain is not to be construed as a vote for or against a motion.

ADDRESSING THE COUNCIL:  Any person addressing the Council shall, when recognized by the Chairperson, step to the podium and give their name and address.  Statements which lack factual support and repeated or cumulative testimony should be avoided.  Groups of people with similar viewpoints are urged to appoint a spokesperson to represent their views.

EXHIBITS OR DOCUMENTS:  Documentary evidence submitted to the Council becomes the property of the Council.

CONTINUANCES:  The Council may continue any matter at its discretion.

 

Matters under the jurisdiction of the Council and not on the posted agenda may be addressed by the general public following completion of the regular agenda.  The Council limits testimony on matters not on the agenda to three minutes per person and not more than fifteen minutes for a particular subject.

REQUEST:      A renewal of a Use Permit to allow a 49-bed residential care facility on approximately 0.9 of an acre in the RD-30 (Residential) zone.

Note: A Variance from building setback requirements and a Special Review of Parking to allow a reduced number of on-site parking spaces were approved with the original Use Permit.  These approvals are not subject to a renewal review.

REQUEST:      A Use Permit to build fifteen (15) condos on approximately 0.84 parcel in the BP (Business Professional) zone.  Thirteen (13) of the proposed units will be two (2) bedroom dwellings located in approximately 14,195 square foot two-story building.  Two (2) of the proposed units will be one (1) bedroom dwellings located in  approximately 2,046 square foot one-story building with garages.

A Waiver from the requirement for a Subdivision Map (Tentative and Final) for condominiums, as allowed by the County Land Development Ordinance Title 22, Section 22.20.076.

An Affordable Housing Plan consisting of the payment of in-lieu and affordability fees.

PROJECT NAME:      8480 Sunset Avenue Wireless Collocation Facility

ENVIRONMENTAL DOC.:  Negative Declaration

REQUEST:      A Use Permit to allow a wireless collocation facility in the “O” (Recreation) zone.  The facility will consist of approximately a 100 foot tall monopole with twelve (12) proposed panel antennas at two elevations.  Related equipment will be housed in an equipment shelter directly to the south of the monopole within a gated compound of  approximately 1,050 square feet.
