SUMMARY OF RULES OF PROCEDURE

 

AGENDA:  The Chairperson may reschedule items on the agenda. Order of the agenda will be: scheduled public hearings then opportunity for the public to address the Council.

CONDUCT OF HEARINGS:  The sequence for a hearing matter is (1) staff report and environmental document discussion; (2) testimony of the applicant(s); (3) public testimony; (4) rebuttal by applicant; (5) close of public hearing; (6) Council discussion and vote.

LIMITED TIME FOR DISCUSSION:  Public testimony will be limited to 3 minutes per speaker.  The Chairperson may grant 5 minutes to a spokesperson of a recognized group.  Applicant testimony and rebuttal may be limited by the Chairperson.

VOTING:  Any action or recommendation of the Council requires a majority (4 votes) of the Council to concur therein.  Any motion for approval or disapproval of a matter which results in a tie vote shall constitute denial if final action is by the Council.  If final action is by the Board of Supervisors, a tie vote shall be forwarded to the Board of Supervisors with no recommendation.  A vote to abstain is not to be construed as a vote for or against a motion.

ADDRESSING THE COUNCIL:  Any person addressing the Council shall, when recognized by the Chairperson, step to the podium and give their name and address.  Statements which lack factual support and repeated or cumulative testimony should be avoided.  Groups of people with similar viewpoints are urged to appoint a spokesperson to represent their views.

EXHIBITS OR DOCUMENTS:  Documentary evidence submitted to the Council becomes the property of the Council.

CONTINUANCES:  The Council may continue any matter at its discretion.

 

Matters under the jurisdiction of the Council and not on the posted agenda may be addressed by the general public following completion of the regular agenda.  The Council limits testimony on matters not on the agenda to three minutes per person and not more than fifteen minutes for a particular subject.

CARMICHAEL BUILDERS, INC. - Engineer:  Area West Engineers - Assessor 's Parcel Nos. 244-0082-017, 028, 029, 030, 031, and 043 through 046, located on the northeast corner of Sunrise Boulevard and Orange Avenue, in the Fair Oaks community. (MacGlashan) (Continued from 1-3-07, item #1)

 

ENVIRONMENTAL DOC.:

Negative Declaration

 

REQUEST:

A Community Plan Amendment of approximately 2.8 gross acres from RD-5 (Residential) to RD-7 (Residential).

A Rezone of approximately 2.8 gross acres from RD-5 (Residential) to RD-7 (Residential).

A Tentative Subdivision Map known as THE VILLAGE AT OLD FAIR OAKS to subdivide the site into either 19 or 17 lots in the RD-7 zone (two options).  In the event that the Community Plan Amendment/Rezone is denied, a Tentative Subdivision Map to divide the site into 14 lots in the RD-5 zone.  (Note:  The applicant has 3 options for the Tentative Subdivision Map, two of which require a Community Plan Amendment and Rezone to RD-7).

A Special Development Permit to allow deviations from the RD-7 (Residential) zone minimum lot size, minimum lot width, and minimum public street frontage requirements (Note:  Portions of the project will be served by a private street system, regardless of the Tentative Map option) and deviation from the RD-7 (Residential) zone minimum front, side, rear and side street setback requirements, and to allow a proposed sound wall along Sunrise Boulevard to be located closer than 15 feet from the right-of-way, regardless of the Tentative Map option.

Abandonment of existing private street easement, and public utility easements.   (Note:  This map will result in replacement easements).

An Affordable Housing Plan consisting of in-lieu and affordability fees.

 

PREVIOUS ACTION:

Tentatively denied the project and findings of fact was prepared.  Project renoticed and continued from January 3, 2007.

Mitigated Negative Declaration

 

REQUEST:

A Development Plan Review to allow a mixed-use commercial project in the Fair Oaks Village Special Planning Area (SPA).  The project would consist of one (1) approximately 50,015 square foot building.  The mixed-use development would be comprised of approximately 19,361 square feet of integrated, partial below-grade structured parking, approximately 15,358 square feet of ground-floor retail (13,822 square feet of leasable retail space), and approximately 15,296 square feet of second floor office space (approximately 13,766 square feet of leasable office space).
