SUMMARY OF RULES OF PROCEDURE

 

AGENDA: The Chairperson may reschedule items on the agenda.  Order of the agenda will be: non-contested matters, contested matters, then staff presentations.

CONDUCT OF HEARINGS: The sequence for a contested matter is: (1) staff report and environmental document discussion; (2) testimony of proponent(s); (3) public testimony; (4) rebuttal by applicant; (5) close of public hearing; (6) Commission discussion and vote.

LIMITED TIME FOR DISCUSSION: A principal proponent will be allowed a 5-minute statement.  Other proponents and opponents are allowed 3-minute statements except that a spokesperson for any group may be allowed 5 minutes.  The principal proponent shall have a 3-minute rebuttal.

VOTING: Any action or recommendation of the Commission requires a majority (3 votes) of the Commission to concur therein.  Any motion for approval or disapproval of a matter which results in a tie vote shall be forwarded to the Board of Supervisors with no recommendation.

ADDRESSING THE COMMISSION: Any person addressing the Commission shall, when recognized by the Chairperson, step to the rostrum and give their name and address.  Statements which lack factual support and repeated or cumulative testimony should be avoided.  Groups of people with similar viewpoints are urged to appoint a spokesperson to represent their views.

EXHIBITS OR DOCUMENTS: Documentary evidence submitted to the Commission becomes the property of the Commission.

CONTINUANCES: The Commission may continue any matter at its discretion.

 

Matters under the jurisdiction of the Commission and not on the posted agenda, may be addressed by the general public following completion of the regular agenda and any off agenda matters before the Commission for consideration.  The Commission limits testimony on matters not on the agenda to three minutes per person and not more than fifteen minutes for a particular subject.

CPAC RECOMMENDATION:

The Carmichael/Old Foothill Farms Community Planning Advisory Council (CPAC) met on March 20, 2013 and recommended APPROVAL (6-0) of the proposed project.

 

ENVIRONMENTAL DOC.:

Exempt

 

REQUEST:

A Tentative Subdivision Map to divide the approximately 0.41-acre site into six (6) single-family detached lots and one (1) common area lot in the RD-20 (Multi-family Residential) zone.  Note:  The subject site was previously approved with a Tentative Subdivision Map (04-SDP-SPP-AHS-PAS-0707) to create six (6) attached lots for townhomes.  This project is changing the subdivision map to six (6) detached single-family lots.  The previous Tentative Subdivision Map was approved on March 15, 2006 and will expire on March 14, 2014.    

 

A Special Development Permit to deviate from the following development standards: a) Reduce the required 24-foot front yard landscaped setback along the public street to approximately 20 feet and to reduce the setback of the garage from 30 feet to 23 feet (Section 305-02 (a)); b) Reduce the rear yard to less than 15 feet for two-story buildings (Section 305-02(4)); c) Reduce the distance between buildings from a minimum of 10 feet to three (3) feet (Section 305-02 (c) (3) (bb)); d) Reduce the required 100-foot setback for structures greater than one story in height to approximately 20 feet adjacent to property zoned RD-10 (Residential), to the west and south (Section 305-12.1). 

 

An Affordable Housing Plan consisting of the payment of in-lieu and affordability fees.

 

A Design Review to comply with the residential design guidelines.

 

 

5:44 PM Board Action: Allan Hoshida/ Stacey McKinley - Recognized the Exempt status of the Environmental Document.  Approved the Tentative Subdivision Map, subject to the findings and conditions recommended by staff as amended.  Approved the Special Development Permit,           No. 2013-SPPC-0002.  Approved the Affordable Housing Plan. Approved the Design Review.
