SUMMARY OF RULES OF PROCEDURE

 

AGENDA:  The Chairperson may reschedule items on the agenda. Order of the agenda will be: scheduled public hearings then opportunity for the public to address the Council.

CONDUCT OF HEARINGS:  The sequence for a hearing matter is (1) staff report and environmental document discussion; (2) testimony of the applicant(s); (3) public testimony; (4) rebuttal by applicant; (5) close of public hearing; (6) Council discussion and vote.

LIMITED TIME FOR DISCUSSION:  Public testimony will be limited to 3 minutes per speaker.  The Chairperson may grant 5 minutes to a spokesperson of a recognized group.  Applicant testimony and rebuttal may be limited by the Chairperson.

VOTING:  Any action or recommendation of the Council requires a majority (4 votes) of the Council to concur therein.  Any motion for approval or disapproval of a matter which results in a tie vote shall constitute denial if final action is by the Council.  If final action is by the Board of Supervisors, a tie vote shall be forwarded to the Board of Supervisors with no recommendation.  A vote to abstain is not to be construed as a vote for or against a motion.

ADDRESSING THE COUNCIL:  Any person addressing the Council shall, when recognized by the Chairperson, step to the podium and give their name and address.  Statements which lack factual support and repeated or cumulative testimony should be avoided.  Groups of people with similar viewpoints are urged to appoint a spokesperson to represent their views.

EXHIBITS OR DOCUMENTS:  Documentary evidence submitted to the Council becomes the property of the Council.

CONTINUANCES:  The Council may continue any matter at its discretion.

 

Matters under the jurisdiction of the Council and not on the posted agenda may be addressed by the general public following completion of the regular agenda.  The Council limits testimony on matters not on the agenda to three minutes per person and not more than fifteen minutes for a particular subject.

PROJECT NAME:

Fair Oaks Open Bible Church Expansion

 

REQUEST:

A Use Permit to expand an existing church and private school facility on approximately 4.4 acres in the RD-5 (Residential) zone.  The proposed project will partially culvert an

on-site tributary of Minnesota Creek and remove all existing buildings on-site.  The proposed project will take place in three phases as follows:

•        Phase I includes the construction of a one-story, approximately 14,650 square foot gym and multi-use building with a seating capacity of 500 seats. 

•        Phase II includes the construction of a two-story, 12,000 square foot education building. 

•        Phase III includes the construction of a one-story, 15,221 square foot worship building with a seating capacity of 500 seats.

A Design Review to comply with the Commercial and Mixed Use Community Design Guidelines.

PLANNING/NEIGHBORHOOD SERVICES REPORT

 

8:45 PM  Board Action: Steve Young reported on parking issues at the Sunrise Assisted Living Center; He mentioned upcoming proposals for Walgreens and Fresh and Easy Grocery Store; Mr. Young reported the keys have been turned over to them as tenants of the new service center and the hope is to open the week of March 31st with the Community Council to start conducting meetings there in May; Victor

Morrison-Vega updated the Council on the report being prepared to go to the Board of Supervisors relative to the future of Community Councils; Chairman Skip Horvath reported on the Community Council Chair's meeting which was held on March 10th.
