SUMMARY OF RULES OF PROCEDURE

 

AGENDA: The Chairperson may reschedule items on the agenda.  Order of the agenda will be: non-contested matters, contested matters, then staff presentations.

CONDUCT OF HEARINGS: The sequence for a contested matter is: (1) staff report and environmental document discussion; (2) testimony of proponent(s); (3) public testimony; (4) rebuttal by applicant; (5) close of public hearing; (6) Commission discussion and vote.

LIMITED TIME FOR DISCUSSION: A principal proponent will be allowed a 5-minute statement.  Other proponents and opponents are allowed 3-minute statements except that a spokesperson for any group may be allowed 5 minutes.  The principal proponent shall have a 3-minute rebuttal.

VOTING: Any action or recommendation of the Commission requires a majority (3 votes) of the Commission to concur therein.  Any motion for approval or disapproval of a matter which results in a tie vote shall be forwarded to the Board of Supervisors with no recommendation.

ADDRESSING THE COMMISSION: Any person addressing the Commission shall, when recognized by the Chairperson, step to the rostrum and give their name and address.  Statements which lack factual support and repeated or cumulative testimony should be avoided.  Groups of people with similar viewpoints are urged to appoint a spokesperson to represent their views.

EXHIBITS OR DOCUMENTS: Documentary evidence submitted to the Commission becomes the property of the Commission.

CONTINUANCES: The Commission may continue any matter at its discretion.

 

Matters under the jurisdiction of the Commission and not on the posted agenda, may be addressed by the general public following completion of the regular agenda and any off agenda matters before the Commission for consideration.  The Commission limits testimony on matters not on the agenda to three minutes per person and not more than fifteen minutes for a particular subject.

An Affordable Housing Plan consisting of the payment of in-lieu and affordability fees.  (Note: The Developer has chosen to pay fees to meet the affordable housing obligation instead of constructing affordable housing units at the development site.  Therefore, affordable housing will not be designated on this site as a part of this project.).

 

An Exception to Title 22.24.630 of the Sacramento County Development Code to allow the subdivision to be served by private water wells.

REQUEST:

A Community Plan Amendment of approximately 13.45 (gross) acres from AR-10 (Agricultural-Residential) to LC (Limited Commercial) for approximately 6.69 gross acres and to RD-20 (Residential) for approximately 6.56 acres.

 

A Rezone of approximately 13.45 (gross) acres from AR-10 (Agricultural-Residential) to LC (Limited Commercial) for approximately 6.69 gross acres and to RD-20 (Residential) for approximately 6.56 acres.

 

A Tentative Subdivision Map to create a total of 12 lots consisting of 10 lots from approximately 6.34 net acres within the LC (Limited Commercial) zone and to create two (2) lots from approximately 6.56 net acres within the RD-20 (Residential) zone.  In addition, Road A has been designated as Lot A on the Tentative Subdivision Map that is approximately 0.63 acres and will be a portion of the LC (Limited Commercial) portion of the project.  Lot B has been designated as an extension of Robbins Road and is approximately 0.27 acres and will be designated as a portion of the LC (Limited Commercial) portion of the project.

 

An Affordable Housing Plan consisting of the construction of onsite 162-unit rental multifamily project.  These units will be separated into two different projects, Arbor Creek family apartments of 94 units and Arbor Creek senior apartments of 68 units.

 

A Special Development Permit for an alternative design.

 

A Special Development Permit to permit a density bonus of 32 units in the RD-20 (Residential) zone.

 

A Design Review to comply with the commercial and mixed use design guidelines and the multifamily design guidelines.

GENERAL PLAN UPDATE

(Approval by the Planning Commission is a recommendation. Final Approval is by the Board of Supervisors)

 

APPLICANT: BOARD OF SUPERVISORS - Contact: David Defanti, Senior Planner - This project proposes adoption of an updated General Plan for the County of Sacramento that will guide growth within the unincorporated County through the year 2030. Approximately 20,000 acres are evaluated for a mixture of development and open space in several new growth areas including: an area west of Watt Avenue in the North Highlands community plan area; the Jackson Highway Corridor, north and south of Jackson Highway in the Rancho Cordova and Vineyard community plan areas; and the Grant Line East area which is east of the City of Rancho Cordova in the Cosumnes community plan area. The land use diagram will also consider a new Commercial Corridor strategy to revitalize a number of key roadway corridors with improvements and additional development. Forward recommendations on the Draft 2030 General Plan to the Board of Supervisors

 

PREVIOUS ACTION:

On July 27, 2009 the Commission closed the public comment period on the Draft Environmental Impact Report, directed the Department of Environmental Review and Assessment (DERA) to respond to comments received and further directed DERA to prepare the Final Environmental Impact Report and continued from 11/23/09, #2.
