SUMMARY OF RULES OF PROCEDURE

 

AGENDA: The Chairperson may reschedule items on the agenda.  Order of the agenda will be: non-contested matters, contested matters, then staff presentations.

CONDUCT OF HEARINGS: The sequence for a contested matter is: (1) staff report and environmental document discussion; (2) testimony of proponent(s); (3) public testimony; (4) rebuttal by applicant; (5) close of public hearing; (6) Commission discussion and vote.

LIMITED TIME FOR DISCUSSION: A principal proponent will be allowed a 5-minute statement.  Other proponents and opponents are allowed 3-minute statements except that a spokesperson for any group may be allowed 5 minutes.  The principal proponent shall have a 3-minute rebuttal.

VOTING: Any action or recommendation of the Commission requires a majority (3 votes) of the Commission to concur therein.  Any motion for approval or disapproval of a matter which results in a tie vote shall be forwarded to the Board of Supervisors with no recommendation.

ADDRESSING THE COMMISSION: Any person addressing the Commission shall, when recognized by the Chairperson, step to the rostrum and give their name and address.  Statements which lack factual support and repeated or cumulative testimony should be avoided.  Groups of people with similar viewpoints are urged to appoint a spokesperson to represent their views.

EXHIBITS OR DOCUMENTS: Documentary evidence submitted to the Commission becomes the property of the Commission.

CONTINUANCES: The Commission may continue any matter at its discretion.

 

Matters under the jurisdiction of the Commission and not on the posted agenda, may be addressed by the general public following completion of the regular agenda and any off agenda matters before the Commission for consideration.  The Commission limits testimony on matters not on the agenda to three minutes per person and not more than fifteen minutes for a particular subject.

REQUEST:

A Use Permit to allow a public utilities facility on approximately 51.3 acres in the IR (SM) (Industrial Reserve-Surface Mining Combining) zone.

 

A Special Development Permit to deviate from the following development standards: a) Reduce the required number of parking spaces from 1,562 spaces to 653 spaces (909 space or 58% reduction). b) Reduce the landscape planter required along the public street frontage from 18 feet to approximately 15-20 feet along Bradshaw Road and to approximately 9 feet along a portion of Kiefer Boulevard. (Section 320-05(a)).  c) Reduce the required interior landscape planters and shade trees in the parking areas not covered by solar panels (Sections 330-94(c) and (d)). d) Allow the height of the building to exceed 40 feet (Section 320-04). e) Allow an 8-foot high block wall within the front yard setback.  (Section 301-60(b)).

 

A Design Review (conceptual) to comply with the commercial and mixed use design guidelines.

Negative Declaration

 

REQUEST:

A Use Permit to allow a collocation wireless communication facility on a 10-acre school site in the RD-2 (Residential) zone.  The proposed facility consists of the replacement of an existing 30-foot light pole with a new 55-foot tall monopole/light pole with three (3) panel antennas, with remote radio units (RRU), and three (3) microwave dish antennas mounted at the 50-foot and 53.9-foot (rad-center) elevations, respectively.  The light will be remounted at the 28-foot elevation.  One (1) equipment cabinet, with a GPS antenna, will be located in a 7-foot by 7-foot fenced lease area.

Negative Declaration

 

REQUEST:

A Use Permit to allow a collocation wireless communication facility on a 9.0-acre park site in the “O” (Recreation) and RD-7 (Residential) zones.  The proposed facility consists of a new 55-foot tall monopole disguised as a pine tree (mono-pine), with three (3) panel antennas, with remote radio units, and three (3) microwave dish antennas mounted at the 51-foot and 54-foot elevations (rad-center), respectively.  One (1) equipment cabinet, with a GPS antenna, will be located near the base of the pole on a 5-foot by 6-foot concrete pad within an overall 20-foot by 15-foot lease area.

REQUEST:

A Use Permit to allow a collocation wireless communication facility on a 3.68 portion of a school site in the RD-4 (Residential) zone.  The proposed facility consists of a new 70-foot tall monopole with three (3) panel antennas, with remote radio units (RRU), and three (3) microwave dish antennas mounted at the 64.75-foot and 68.75-foot (rad-center) elevations, respectively.  One (1) equipment cabinet, with a GPS antenna, will be located near the base of the pole on a 20-foot by 20-foot fenced lease area.  The use permit would also allow the height of the monopole to exceed the 55-foot height restriction (Sections 301-13.5(d)(3)(bb) and (cc)).

A Use Permit to allow a collocation wireless communication facility on a 10.8-acre school site in the RD-5 (Residential) zone.  The proposed facility consists of a new 65-foot tall monopole with three (3) panel antennas, with remote radio units (RRU), and three (3) microwave dish antennas mounted at the 59.75-foot and 63.75 foot (rad-center) elevations, respectively.  One (1) equipment cabinet, with a GPS antenna, will be located near the base of the pole in a 10-foot by 10-foot fenced lease area.  The use permit would also allow the height of the monopole to exceed the 55-foot height restriction and be located within 25 feet of an adjacent interior property line (Sections 301-13.5 (d) (3) (aa) (bb) and (cc)).

A Use Permit to allow a collocation wireless communication facility on a 35-acre school site in the RD-4 (Residential) zone.  The proposed facility consists of a new 80-foot tall monopole with three (3) panel antennas, with remote radio units (RRU), and three (3) microwave dish antennas mounted at the 74.75-foot and 78.75-foot (rad-center) elevations, respectively.  One (1) equipment cabinet, with a GPS antenna, will be located near the base of the pole in a 20-foot by 20-foot fenced lease area.  The use permit would also allow the height of the monopole to exceed the 55-foot height restriction (Sections 301-13.5(d)(3)(bb) and (cc)).
