SUMMARY OF RULES OF PROCEDURE

 

AGENDA:  The Chairperson may reschedule items on the agenda. Order of the agenda will be: scheduled public hearings then opportunity for the public to address the Commission.

CONDUCT OF HEARINGS:  The sequence for a hearing matter is (1) staff report and environmental document discussion; (2) testimony of the applicant(s); (3) public testimony; (4) rebuttal by applicant; (5) close of public hearing; (6) Commission discussion and vote.

LIMITED TIME FOR DISCUSSION:  Public testimony will be limited to 3 minutes per speaker.  The Chairperson may grant 5 minutes to a spokesperson of a recognized group.  Applicant testimony and rebuttal may be limited by the Chairperson.

VOTING:  Any action or recommendation of the Commission requires a majority (4 votes) of the Commission to concur therein.  Any motion for approval or disapproval of a matter which results in a tie vote shall constitute denial if final action is by the Commission.  If final action is by the Board of Supervisors, a tie vote shall be forwarded to the Board of Supervisors with no recommendation.  A vote to abstain is not to be construed as a vote for or against a motion.

ADDRESSING THE COMMISSION:  Any person addressing the Commission shall, when recognized by the Chairperson, step to the podium and give their name and address.  Statements which lack factual support and repeated or cumulative testimony should be avoided.  Groups of people with similar viewpoints are urged to appoint a spokesperson to represent their views.

EXHIBITS OR DOCUMENTS:  Documentary evidence submitted to the Commission becomes the property of the Commission.

CONTINUANCES:  The Commission may continue any matter at its discretion.

 

Matters under the jurisdiction of the Commission and not on the posted agenda may be addressed by the general public following completion of the regular agenda.  The Commission limits testimony on matters not on the agenda to three minutes per person and not more than fifteen minutes for a particular subject.

Fair Oaks Open Bible Church Expansion

 

ENVIRONMENTAL DOC.:

Mitigated Negative Declaration

 

REQUEST:

A Use Permit to expand an existing church and private school facility on approximately 4.4 acres in the RD-5 (Residential Density 5) zone.  The proposed project will partially culvert an on-site tributary of Minnesota Creek and remove all existing buildings on-site.  The proposed project will take place in three phases as follows:

 

•        Phase I includes the construction of a one-story, approximately 14,650 square foot gym and multi-use building with a seating capacity of 500 seats along with approximately 1,922 square feet children’s play area. 

•        Phase II includes the construction of a two-story, 12,000 square foot education building. 

•        Phase III includes the construction of a one-story, 15,221 square foot worship building with a seating capacity of 500 seats.

 

 A Special Review of Parking to allow the church and private school to share the 167 parking spaces required for each use, per Sacramento County Zoning Code Sections 330-49 and 330-53.  The total number of parking spaces on-site will be 175 spaces after project completion of the three phases.  Note:  After the end of Phase I, the site will have a total of 135 parking spaces on-site and will need to provide 40 parking spaces off-site through a shared parking agreement with the church across the street from the site.

 

 A Design Review to comply with the Commercial and Mixed Use Community Design Guidelines.
