SUMMARY OF RULES OF PROCEDURE

 

AGENDA: The Chairperson may reschedule items on the agenda.  Order of the agenda will be: non-contested matters, contested matters, then staff presentations.

CONDUCT OF HEARINGS: The sequence for a contested matter is: (1) staff report and environmental document discussion; (2) testimony of proponent(s); (3) public testimony; (4) rebuttal by applicant; (5) close of public hearing; (6) Commission discussion and vote.

LIMITED TIME FOR DISCUSSION: A principal proponent will be allowed a 5-minute statement.  Other proponents and opponents are allowed 3-minute statements except that a spokesperson for any group may be allowed 5 minutes.  The principal proponent shall have a 3-minute rebuttal.

VOTING: Any action or recommendation of the Commission requires a majority (3 votes) of the Commission to concur therein.  Any motion for approval or disapproval of a matter which results in a tie vote shall be forwarded to the Board of Supervisors with no recommendation.

ADDRESSING THE COMMISSION: Any person addressing the Commission shall, when recognized by the Chairperson, step to the rostrum and give their name and address.  Statements which lack factual support and repeated or cumulative testimony should be avoided.  Groups of people with similar viewpoints are urged to appoint a spokesperson to represent their views.

EXHIBITS OR DOCUMENTS: Documentary evidence submitted to the Commission becomes the property of the Commission.

CONTINUANCES: The Commission may continue any matter at its discretion.

 

Matters under the jurisdiction of the Commission and not on the posted agenda, may be addressed by the general public following completion of the regular agenda and any off agenda matters before the Commission for consideration.  The Commission limits testimony on matters not on the agenda to three minutes per person and not more than fifteen minutes for a particular subject.

REQUEST:

A General Plan Amendment for the FVGCP area to relocate the Urban Policy Area (UPA) boundary and to amend the land use designations as identified by the Existing and Proposed General Plan Lane Use diagrams, for properties within the FVGCP project area.

 

A Community Plan Amendment to amend the land use designations for properties within the FVGCP as identified by the Existing Zoning/Community Plan Designations diagram to either the proposed CAC Land Use Plan, or the proposed PD Land Use Plan. Note that there are two land use options--a less intense option proposed by the CAC, and a more intense option proposed by County Planning staff. The approval of either land use option would result in amendments to both the South Sacramento and Vineyard Community Plans.

 

A Public Facilities Financing Plan for the Florin-Vineyard Gap Community Plan project area, which: a) Identifies public facilities and infrastructure improvements required to support the proposed land uses; b) Defines proposed methods for financing required public facilities and infrastructure; and c) Provides a description of infrastructure phasing.

CPAC RECOMMENDATION:

The Joint Vineyard and South Sacramento Community Planning Advisory Council (CPAC) met on August 18, 2009 and recommended APPROVAL of the proposed project.  The joints CPAC supported keeping the RD-20 (Residential) site at its proposed location (east of Elk Grove-Florin Road) and recommended replacing the RD-20 (Residential) designated site at the northwest corner of Elk Grove-Florin Road and Florin Road for Business Professional (BP) designation.

 

ENVIRONMENTAL DOC.:

Draft Environmental Impact Report

 

REQUEST:

A Rezone of approximately 101.6 gross acres from A-10 (Agricultural) and IR (Industrial Reserve) to RD-2 (Residential), 26.7 acres; RD-4 (Residential), 16.8 acres; RD-5 (Residential), 28.2 acres; RD-7 ((Residential), 12.9 acres; RD-20 (Residential), 9.5 acres; and O (Recreation), 7.5 acres, for a park site.

 

A Tentative Subdivision Map to divide approximately 101.6 gross acres into 372 single-family residential lots, one (1) multiple-family affordable residential lot, one (1) church lot, one (1) park site lot, and two (2) landscape corridor lots.  Included on the Map are requests for abandonment of easement(s).

 

A Special Development Permit to allow deviations from the lot size and width standards applicable to lots created in the RD-4 (Residential) , RD-5 (Residential) and RD-7 (Residential) zones.

 

A Special Development Permit to allow an affordable housing density bonus of 84 single-family lots as permitted by the Affordable Housing Ordinance to off-set those units lost to affordable housing.

 

An Exception to Title 22 to allow lots less than 95 feet deep and to allow the depth of the lots to exceed three times its width.

 

An Affordable Housing Plan with options for construction of onsite rental multi-family units or land dedication.
