SUMMARY OF RULES OF PROCEDURE

 

AGENDA:  The Chairperson may reschedule items on the agenda. Order of the agenda will be: scheduled public hearings then opportunity for the public to address the Council.

CONDUCT OF HEARINGS:  The sequence for a hearing matter is (1) staff report and environmental document discussion; (2) testimony of the applicant(s); (3) public testimony; (4) rebuttal by applicant; (5) close of public hearing; (6) Council discussion and vote.

LIMITED TIME FOR DISCUSSION:  Public testimony will be limited to 3 minutes per speaker.  The Chairperson may grant 5 minutes to a spokesperson of a recognized group.  Applicant testimony and rebuttal may be limited by the Chairperson.

VOTING:  Any action or recommendation of the Council requires a majority (4 votes) of the Council to concur therein.  Any motion for approval or disapproval of a matter which results in a tie vote shall constitute denial if final action is by the Council.  If final action is by the Board of Supervisors, a tie vote shall be forwarded to the Board of Supervisors with no recommendation.  A vote to abstain is not to be construed as a vote for or against a motion.

ADDRESSING THE COUNCIL:  Any person addressing the Council shall, when recognized by the Chairperson, step to the podium and give their name and address.  Statements which lack factual support and repeated or cumulative testimony should be avoided.  Groups of people with similar viewpoints are urged to appoint a spokesperson to represent their views.

EXHIBITS OR DOCUMENTS:  Documentary evidence submitted to the Council becomes the property of the Council.

CONTINUANCES:  The Council may continue any matter at its discretion.

 

Matters under the jurisdiction of the Council and not on the posted agenda may be addressed by the general public following completion of the regular agenda.  The Council limits testimony on matters not on the agenda to three minutes per person and not more than fifteen minutes for a particular subject.

REQUEST:

A Use Permit to allow a drive-up window for a pharmacy without amplified sound within approximately 51 feet of an RD-10 (Residential) zone.  Sacramento County Zoning Code Section 315-22(e) requires drive-up windows without amplified sound to have a minimum separation distance of 75 feet from residential zones.

 

A Special Development Permit to deviate from the following Sacramento County Zoning Code (SZC) Standards for Commercial Uses on approximately 3.74 acres in the LC (Limited Commercial) zone:

 

a. A Deviation from the side yard setback adjacent to RD-10 (Residential) uses from 25 feet to approximately 20 feet, per SZC Section 315-43(b).

 

b. A Deviation from the loading dock for the Fresh & Easy Grocery Store adjacent to RD-10 (Residential) uses from 75 feet to between approximately 42 and approximately 50 feet, per SZC Section 315-43(f).

 

An Abandonment of public right-of-way along the proposed project site’s street frontage on Madison and Kenneth Avenues.

 

A Design Review to comply with the Commercial and Mixed Use Community Design Guidelines.

 

Note:  The project is inconsistent with General Plan Land Use Policy LU-14, which requires all new development located within one-half mile of a transportation corridor to conform to certain density requirements specified in the General Plan.  The project contains floor area ratios less than those specified in the General Plan.  The Board of Supervisors is the appropriate authority to determine that densities specified in the General Plan are not feasible for this site.

A Use Permit to build 26 condo units on approximately 1.01 acres in the Fair Oaks Village Special Planning Area (SPA), as required pursuant to the Fair Oaks Village SPA Section 502-15.

 

An Affordable Housing Plan consisting of the payment of in-lieu and affordability fees.  (Note:  The Developer has chosen to pay fees to meet the affordable housing obligation instead of constructing affordable housing units at the development site.  Therefore, affordable housing will not be built on this site.)
