SUMMARY OF RULES OF PROCEDURE

 

AGENDA: The Chairperson may reschedule items on the agenda.† Order of the agenda will be: non-contested matters, contested matters, then staff presentations.

CONDUCT OF HEARINGS: The sequence for a contested matter is: (1) staff report and environmental document discussion; (2) testimony of proponent(s); (3) public testimony; (4) rebuttal by applicant; (5) close of public hearing; (6) Commission discussion and vote.

LIMITED TIME FOR DISCUSSION: A principal proponent will be allowed a 5-minute statement.† Other proponents and opponents are allowed 3-minute statements except that a spokesperson for any group may be allowed 5 minutes.† The principal proponent shall have a 3-minute rebuttal.

VOTING: Any action or recommendation of the Commission requires a majority (3 votes) of the Commission to concur therein.† Any motion for approval or disapproval of a matter which results in a tie vote shall be forwarded to the Board of Supervisors with no recommendation.

ADDRESSING THE COMMISSION: Any person addressing the Commission shall, when recognized by the Chairperson, step to the rostrum and give their name and address.† Statements which lack factual support and repeated or cumulative testimony should be avoided.† Groups of people with similar viewpoints are urged to appoint a spokesperson to represent their views.

EXHIBITS OR DOCUMENTS: Documentary evidence submitted to the Commission becomes the property of the Commission.

CONTINUANCES: The Commission may continue any matter at its discretion.

 

Matters under the jurisdiction of the Commission and not on the posted agenda, may be addressed by the general public following completion of the regular agenda and any off agenda matters before the Commission for consideration.† The Commission limits testimony on matters not on the agenda to three minutes per person and not more than fifteen minutes for a particular subject.

The Southeast Community Planning Advisory Council (CPAC) met on October 4, 2010 and recommended APPROVAL (7-0) of the initial project request.

 

ENVIRONMENTAL DOC.:

REQUEST:

A Use Permit to legalize an existing outdoor recreational facility (Airsoft pellets) in an open field on a portion of an 18.5-acre parcel in the AG-20 (Permanent Agricultural) and AG-20(F) (Flood combining) zones.† Note that corn mazes and pumpkin patches are permitted activities where agricultural uses are practiced.

 

A Special Development Permit to deviate from the following Zoning Code provisions: a) To allow the internal access aisles to be gravel in lieu of a dust free surface. b) To allow the parking lot to be gravel instead of a dust free surface. c) To allow zero landscaping adjacent to East Stockton Boulevard in lieu of providing a landscaped planter 18 feet in width. d) To allow reduced landscaping internal to the parking lot in lieu of a minimum shading requirement of 40 percent.

REQUEST:

A Tentative Parcel Map to subdivide approximately 1.71 acres into four (4) lots in the RD-20 (Multiple Family) zone.

 

A Special Development Permit to deviate from the Multiple Family Development Standards to allow the following:† a) To allow the parking area to be less than thirty-one (31) feet from the right-of-way of Lang Avenue for the triplex unit; b) To allow the side yard setback of the triplex to be 5.18 feet rather than the required 10 feet as stated in Section 305-14(a) of the zoning code; c) To allow the access drive to be less than 10 feet from the habitated portion of the dwelling for the triplex unit as stated in Section 305-16(b)(5); d) To allow the side yard to be less than five (5) feet for the duplex unit as stated in Section 305-53 (b).

 

An Exception to Title 22.110.070(d) of the Land Development Ordinance to allow the depths of proposed Parcels 1, 2, and 3 to be less than 95 feet.
