SUMMARY OF RULES OF PROCEDURE

 

AGENDA: The Chairperson may reschedule items on the agenda.  Order of the agenda will be: non-contested matters, contested matters, then staff presentations.

CONDUCT OF HEARINGS: The sequence for a contested matter is: (1) staff report and environmental document discussion; (2) testimony of proponent(s); (3) public testimony; (4) rebuttal by applicant; (5) close of public hearing; (6) Commission discussion and vote.

LIMITED TIME FOR DISCUSSION: A principal proponent will be allowed a 5-minute statement.  Other proponents and opponents are allowed 3-minute statements except that a spokesperson for any group may be allowed 5 minutes.  The principal proponent shall have a 3-minute rebuttal.

VOTING: Any action or recommendation of the Commission requires a majority (3 votes) of the Commission to concur therein.  Any motion for approval or disapproval of a matter which results in a tie vote shall be forwarded to the Board of Supervisors with no recommendation.

ADDRESSING THE COMMISSION: Any person addressing the Commission shall, when recognized by the Chairperson, step to the rostrum and give their name and address.  Statements which lack factual support and repeated or cumulative testimony should be avoided.  Groups of people with similar viewpoints are urged to appoint a spokesperson to represent their views.

EXHIBITS OR DOCUMENTS: Documentary evidence submitted to the Commission becomes the property of the Commission.

CONTINUANCES: The Commission may continue any matter at its discretion.

 

Matters under the jurisdiction of the Commission and not on the posted agenda, may be addressed by the general public following completion of the regular agenda and any off agenda matters before the Commission for consideration.  The Commission limits testimony on matters not on the agenda to three minutes per person and not more than fifteen minutes for a particular subject.

ENVIRONMENTAL DOC.:

Negative Declaration

 

REQUEST:

A Use Permit to allow:

 

a.  A single story skilled nursing facility with up to 78 beds and physical therapy services on a parcel that is 3.87 acres in the RD-5 zone.

 

b.  A deviation from the development standards for identification signs of the Sacramento County Zoning Code (5.10.1.M (3)). The proposed sign will exceed the height and area standards for monument signs. 

 

A Special Development Permit to allow for the following deviations from the development standards for fences of the Sacramento County Zoning Code.

 

a.  To forgo the construction of roughly 410 feet of fencing along the southern property line adjacent to A.P.N. 229-0070-011, which is zoned as RD-5  (SCZC 5.2.5.C (2)).

 

b.  Deviate from retaining wall height standards along interior residential properties (SCZC 5.2.5.B (3)). The proposed project will incorporate retaining walls that will range in height, but will exceed 4 feet in height along the southern property boundary to address existing grade changes.

 

A Design Review to comply with the Countywide Design Guidelines.

ENVIRONMENTAL DOC.:

Negative Declaration

 

REQUEST:

A Use Permit to allow a 672-square-foot, 50-foot high digital billboard on approximately 10.35 acres in the LC (Limited Commercial) zone.

 

A Special Development Permit to allow for the following deviations from Zoning Code Sections: 

 

5.10.1.N.8.d. Location: Allow a 311-foot setback, rather than the required 500-foot setback from a residential zone (located across Interstate 80 from the proposed project site);

 

5.10.1. N.11. Removal of Existing Signs: Allow the sign, without requiring that 25 percent of the removed signage be from a site located within a Special Sign Corridor.

 

A Design Review to comply with the Limited Commercial development standards for signs.

 

A Development Agreement that includes the removal of five signs in the Carmichael-Old Foothill Farms community.

Aspen  VIII  and  IX  Mining

 

CPAC RECOMMENDATION:

The Vineyard Community Planning Advisory Council (CPAC) met on April 5, 2016 and recommended 5-0 for APPROVAL.

 

ENVIRONMENTAL DOC.:

Draft Environmental Impact Report

 

REQUEST:

A Use Permit to allow surface mining on approximately 353 acres of a 683-acre project site.

 

A Use Permit to allow a conveyor system to transport the mined materials across adjacent parcels to an

off-site processing plant.

 

Community Plan Amendment and Rezone to add the Surface Mining Combining Zone (SM) to 682 acres of IR, AG-80, AG-80 (F), AG-160 and AG-160 (F) land.  Note: the acreage to be rezoned (682) is one acre less than the 683 acre project site because the conveyor extension on parcel 063-0190-027 does not require a rezone.

 

A Reclamation Plan to include open space grassland uses as the end use of the mine.

 

A Development Agreement between the applicant and the County of Sacramento.
