SUMMARY OF RULES OF PROCEDURE

 

AGENDA:  The Chairperson may reschedule items on the agenda. Order of the agenda will be: scheduled public hearings then opportunity for the public to address the Council.

CONDUCT OF HEARINGS:  The sequence for a hearing matter is (1) staff report and environmental document discussion; (2) testimony of the applicant(s); (3) public testimony; (4) rebuttal by applicant; (5) close of public hearing; (6) Council discussion and vote.

LIMITED TIME FOR DISCUSSION:  Public testimony will be limited to 3 minutes per speaker.  The Chairperson may grant 5 minutes to a spokesperson of a recognized group.  Applicant testimony and rebuttal may be limited by the Chairperson.

VOTING:  Any action or recommendation of the Council requires a majority (4 votes) of the Council to concur therein.  Any motion for approval or disapproval of a matter which results in a tie vote shall constitute denial if final action is by the Council.  If final action is by the Board of Supervisors, a tie vote shall be forwarded to the Board of Supervisors with no recommendation.  A vote to abstain is not to be construed as a vote for or against a motion.

ADDRESSING THE COUNCIL:  Any person addressing the Council shall, when recognized by the Chairperson, step to the podium and give their name and address.  Statements which lack factual support and repeated or cumulative testimony should be avoided.  Groups of people with similar viewpoints are urged to appoint a spokesperson to represent their views.

EXHIBITS OR DOCUMENTS:  Documentary evidence submitted to the Council becomes the property of the Council.

CONTINUANCES:  The Council may continue any matter at its discretion.

 

Matters under the jurisdiction of the Council and not on the posted agenda may be addressed by the general public following completion of the regular agenda.  The Council limits testimony on matters not on the agenda to three minutes per person and not more than fifteen minutes for a particular subject.

REQUEST:

A Tentative Subdivision Map, known as TAYLOR OAK ESTATES, to divide 2.50 gross acres into six (6) lots, in the RD 3 (single-family) zone.

An Exception to allow exclusive use of a private drive for access.  Note:  The access drive is proposed to be gated.

An Affordable Housing Plan consisting of payment of in-lieu fees.  The owner has chosen to pay in-lieu fees and affordability fees to meet the affordable housing obligation instead of constructing affordable housing units on this site.  Therefore, affordable housing will not be built as part of this project.

REQUEST:

:  A Tentative Parcel Map to divide approximately 4.58 gross acres into two (2) lots in the BP Business Professional (PD) Planned Development zone.  Two (2) office buildings, comprising of approximately 36,566 gross square feet, are already located on the property.

A Variance to reduce the required public street frontage for proposed Parcel 2 from 60 feet to approximately zero (0) feet, pursuant to Sacramento County Zoning Code Section 315-41.
