SUMMARY OF RULES OF PROCEDURE

 

AGENDA:  The Chairperson may reschedule items on the agenda. Order of the agenda will be: scheduled public hearings then opportunity for the public to address the Commission.

CONDUCT OF HEARINGS:  The sequence for a hearing matter is (1) staff report and environmental document discussion; (2) testimony of the applicant(s); (3) public testimony; (4) rebuttal by applicant; (5) close of public hearing; (6) Commission discussion and vote.

LIMITED TIME FOR DISCUSSION:  Public testimony will be limited to 3 minutes per speaker.  The Chairperson may grant 5 minutes to a spokesperson of a recognized group.  Applicant testimony and rebuttal may be limited by the Chairperson.

VOTING:  Any action or recommendation of the Commission requires a majority (4 votes) of the Commission to concur therein.  Any motion for approval or disapproval of a matter which results in a tie vote shall constitute denial if final action is by the Commission.  If final action is by the Board of Supervisors, a tie vote shall be forwarded to the Board of Supervisors with no recommendation.  A vote to abstain is not to be construed as a vote for or against a motion.

ADDRESSING THE COMMISSION:  Any person addressing the Commission shall, when recognized by the Chairperson, step to the podium and give their name and address.  Statements which lack factual support and repeated or cumulative testimony should be avoided.  Groups of people with similar viewpoints are urged to appoint a spokesperson to represent their views.

EXHIBITS OR DOCUMENTS:  Documentary evidence submitted to the Commission becomes the property of the Commission.

CONTINUANCES:  The Commission may continue any matter at its discretion.

 

Matters under the jurisdiction of the Commission and not on the posted agenda may be addressed by the general public following completion of the regular agenda.  The Commission limits testimony on matters not on the agenda to three minutes per person and not more than fifteen minutes for a particular subject.

REQUEST:

A Use Permit to legalize an existing approximately 1,024 square foot residential accessory dwelling, built in 2005 on approximately 0.46 of an acre in the RD-5 (Residential) NPA (National Preservation Area) zone.

 

A Use Permit to exceed fifty (50%) percent of the habitable floor area of the approximately 1,600 square foot primary residential dwelling for non-habitable structures (garage) on the same parcel as per Section 305-82(b) of the Sacramento County Zoning Code.

 

A Deviation to allow the height of the accessory dwelling to exceed 16 feet (21 feet 8 inches proposed), the rear yard setback to be less than 25 feet (4 feet proposal), and the side yard setback to be less than 5 feet (3 feet proposed) for a two-story structure, pursuant to Sacramento County Zoning Code Section 305-83.

REQUEST:

A Use Permit to allow the expansion of an existing church and private school consisting of a new 9,900 square foot parish hall, with parking lot and landscaping, on a 1.03-acre portion of the church site.  The subject property is zoned RD-5 (Residential).

 

A Special Development Permit to allow an alternative design by deviating from the following development standards:

a.       Reduce the landscape planter required along Pennsylvania Avenue

          from 25 feet to approximately 12 feet (Section 320-05(a)).

b.       Reduce the required perimeter landscape planter from 6 feet to

          approximately 4 feet along a portion of the east property line

          (Section 320-05(b)).

c.       Deviate from interior landscape planter spacing requirements along

          the north property line (Section 330-94(c)).
